Warranty Information

BANNERSAVER LIMITED WARRANTY (“Agreement”)

Britten, Inc. (“Seller”) provides a fifteen-year limited warranty on certain BannerSaver™ products against material defects in product design and manufacturing, as well as warrantying performance of the product up to its wind-spilling capabilities as outlined in the BannerSaver™ Wind Tunnel Test Report, assuming proper installation methods and subject to the warranty limitations described herein. During this warranty period, Seller will replace or repair the BannerSaver™ bracket assembly, which includes the base bracket/nose, screw, washers, and spring. This warranty does not apply to any accessory elements of the bracket, such as the fiberglass bracket arms, safety pins, or other similar items not included as part of the bracket assembly. This warranty applies only to the original purchaser of the bracket (“Buyer”) and is in lieu of all other warranties either expressed or implied for a period of fifteen years from the date of purchase (“Warranty Period”).

Warranty Limitations. The warranties under this Agreement do not apply where the brackets have:

  • been subjected to abuse, misuse, neglect, negligence, accident, alteration, corrosive environments, improper testing, improper installation, improper storage, improper handling, abnormal physical stress, abnormal environmental condition, or use contrary to any instructions issued by Britten, Inc.;
  • been damaged due to weather conditions rated F-0 and higher (65mph) on the National Weather Service Fujita Scale;
  • been mounted and installed on walls of any kind;
  • been reconstructed, repaired, or altered by persons other than Britten, Inc. or its authorized representative; or
  • been used with any third-party product, hardware, or product that has not been previously approved in writing by Britten, Inc.

Exclusive Remedy for Defective Goods. Notwithstanding any other item, this Agreement contains Buyer’s exclusive remedy for goods that fall under this warranty (“Defective Goods”). Buyer’s remedy under this Agreement is conditioned on Buyer’s compliance with its obligations below. During the Warranty Period, regarding any allegedly Defective Goods:

  • Buyer shall notify Seller, in writing, of any alleged claim or defect within 15 business days from the date Buyer discovers, or on reasonable inspection should have discovered, such alleged claim or defect (but in any event before the expiration of the applicable Warranty Period);
  • Buyer shall ship, at Buyer’s expense and risk of loss, the allegedly nonconforming goods, along with clear pictures of installation of the Defective Goods including proper banding, and National Weather Service’s reporting based on the day of the incident, to Britten, Inc.’s facility designated by Britten for inspection and testing by Seller;
  • If Seller’s inspection and testing reveals, to Seller’s reasonable satisfaction, that such Defective Goods and any such defect has not been caused or contributed to by any of the factors described above, Seller shall in its sole discretion, and at its expense, (a) repair or replace Defective Goods or (b) credit or refund the price of Defective Goods less any applicable discounts, rebates, or credits; and
  • If Seller exercises its option to repair or replace, Seller shall, after receiving Buyer’s shipment of Defective Goods, ship to Buyer, at Buyer’s expense and risk of loss, the repaired or replaced goods to the delivery location designated by Buyer.

Buyer has no right to return for repair, replacement, credit, or refund any goods except as set forth in this Agreement. In no event shall Buyer reconstruct, repair, alter, or replace any goods, in whole or in part, either itself or by or through any third party.

THIS SECTION SETS FORTH BUYER’S SOLE REMEDY AND SELLER’S ENTIRE LIABILITY FOR ANY BREACH OF THE LIMITED WARRANTY.

BannerSaver™ customers recognize that performance related products like the BannerSaver™ require occasional maintenance including checking for loose banding and/or the replacement of bands. We encourage customers to remove light pole banners from poles when a known F-O or higher storm is expected.

Important notes:

• Domestic (United States) sales to resellers and end-users are made upon the explicit, mutual understanding that all installations will be within the United States unless previously agreed upon in writing.
